Acceptable User Policy - Accommodation Provider

1. INTRODUCTION
1.1. This Acceptable Use Policy – Accommodation Provider is applicable to your use of the housingnet.com.au Platform to display residential property listings, accommodation profile information and the housingnet.com.au Admin System to upload property listings for display on the housingnet.com.au Platform (“the Service”).
1.2. This Acceptable Use Policy – Accommodation Provider forms part of your agreement with us for the Service.
1.3. We may change this Acceptable Use Policy – Accommodation Provider as set out in the Terms and Conditions for the Service.
1.4. We reserve our rights to maintain the quality of listing and accommodation profile content on housingnet.com.au by making such directions in relation to modification of content that we consider reasonable in the circumstances. The rules in this Acceptable Use Policy – Accommodation Provider are a list of our requirements. We may direct you to modify content provided that such direction is reasonable in the circumstances.
1.5. We may, acting reasonably and in good faith, interpret and apply the rules below in such manner that is appropriate having regard to our need to maintain the quality and integrity of our Platform.
2. YOUR OBLIGATIONS
2.1. You must comply with the provisions of this Acceptable Use Policy – Accommodation Provider.
2.2. You must only use the Service for the purposes for which it was designed and provided and not for any other purpose including, without limitation any purpose set out in this Acceptable Use Policy – Accommodation Provider.
2.3. You must use the Service in a responsible manner, taking into account the effects your use of the Service may have on other users of the Service and the housingnet.com.au Platform.
3. ACCEPTABLE USE
3.1. It is acceptable to use the Service for the listing of real property, in accordance with the applicable Terms and Conditions for the Service and terms of this Acceptable Use Policy – Accommodation Provider.
3.2. Transparent watermark with no colour inserted in the bottom right-hand corner of the image with surface area no greater than 5% of the total image’s surface area.
4. NOT ACCEPTABLE USE
4.1. NOT ACCEPT listings other than real property: Listing anything other than real property. For example: cars, car spaces, boats, caravans, and portable homes are not acceptable listings on housingnet.com.au.
4.2. NOT ACCEPT advertising your business by text within the photo gallery more than 5% of the area of a picture. For example: using the service to advertise your business or its services as a property listing is not acceptable. It is also not acceptable to include dedicated marketing content about your agency or providers within a listing, including images (such as photographs of providers).
4.3. NOT ACCEPT incorrect information of properties
4.4. NOT ACCEPT listing certain kinds of unacceptable properties.
4.5. NOT ACCEPT listing more than one property in a single unique listing. A residential listing may only be used to advertise a single unique property.
4.6. NOT ACCEPT to feature the commercial property as the main component of the advertisement.
4.7. NOT ACCEPT listings which are not in relation to a specific lot number or address (for example ‘various properties available’).
4.8. NOT ACCEPT misuse of fields: Placing irrelevant information in an information, description or picture field of a listing. You must only use the information, description or picture fields for inserting information that is intended for those fields. For example, inserting the name or contact details of your vendor or landlord is not acceptable.
4.9. NOT ACCEPT inappropriate watermarks in photos: Inserting any watermark, including an agency name in a property listing is not acceptable unless it takes the form of a transparent watermark with no colour inserted in the bottom right-hand corner of the image with surface area of no greater than 5% of the total image’s surface area.
4.10. NOT ACCEPT incorrect photos or pictures: Displaying a photograph, drawing, or other image that is not a photograph, drawing, or image of the property being offered as the main image. Displaying photos of properties other than real property.
4.11. NOT ACCEPT the image functionality for any unlawful, illegal, malicious, or improper purpose. For example, it is not acceptable to display images that: may defame or discredit another person or business; may disclose private, personal or confidential information; might be considered obscene, offensive, menacing or abusive; might infringe the intellectual property rights of others; or may violate any law, regulation, standard, content requirements or code promulgated by any relevant authority or industry body.
4.12. NOT ACCEPT borders around photos or pictures: Displaying a photograph, drawing or other image within a border that we consider detracts from the quality of the image on a listing.
4.13. NOT ACCEPT text or marketing in photos or pictures: Displaying text within a photograph, drawing or other images that we consider detracts from the quality of the image on a listing, or displaying any agency marketing material through the use of branded objects in photos, such as signboards, cars board number, or brand name of a coffee cups.
4.14. NOT ACCEPT photo or image collages: Displaying a collage or combination of photos or other images within one frame on a listing.
4.15. NOT ACCEPT displaying ‘Lifestyle’ images as main image: Displaying a ‘lifestyle’ photograph, drawing or other image as the main image in a property listing. We will have discretion to determine what constitutes a ‘lifestyle’ image for this purpose, but for guidance, a lifestyle image will commonly be an image of some local environmental or structural feature or amenity, and not an image of the exterior or interior of the property itself.
4.16. NOT ACCEPT incorrect street and place names: Using Street names, suburbs or location names that are inaccurate or not officially recognised. For example: stating that a property is within a neighbouring suburb is not acceptable.
4.17. NOT ACCEPT duplicate listing of properties: A genuine listing of multiple units at the same address is not considered a duplicate listing of properties.
4.18. NOT ACCEPT large files: You must ensure that the graphic file submitted by you for your logo is no larger than 25Mb / picture item in memory size.
4.19. NOT ACCEPT video URL unrelated to your property post.
4.20. NOT ACCEPT listing without authority: Listing property that you have not been authorised. If applicable, for which you must submit and get approval by official email from us.
4.21. NOT ACCEPT impersonating other persons: Using the Service in a way that is impersonating another person or persons.
4.22. NOT ACCEPT reposting an existing Post or its content from any other member. We do not accept posting content or images of any assets existing on the platform in any form, whether it is because you post it yourself, because you allow others to post it, or because you need to advertise. We have the sole right to decide to suspend any properties that are reposted. This gives every listed property a fair chance of benefiting.
4.23. NOT ACCEPT references to third parties or third party websites: Publish advertisements with the Services that contain references to third parties (e.g., another providers).
4.24. NOT ACCEPT Including hyperlinks or any other form of link or direction to any website or app unless expressly authorised by Us.
4.25. NOT ACCEPT Misleading or deceptive conduct: Using the Service in a way that does or is likely to mislead and deceive the public users of housingnet.com.au. This is the case regardless of what content is considered misleading or deceptive. Without limiting the generality of this restriction, we may deem the following conduct misleading and deceptive.
4.26. NOT ACCEPT listing a property after the successful transaction has been resolved. That is, the property has been entered into a contract with full signatures of both parties. To avoid any doubt, You may not post this property in any form until the above contract period expires.
4.27. NOT ACCEPT the Video Functionality in a way that is likely to mislead or deceive users of housingnet.com.au.You must adhere to the technical requirements for embedded property videos communicated to you from time to time.
4.28. NOT ACCEPT the Video Functionality for any unlawful, illegal, malicious, or improper purpose. For example, it is not acceptable to display images or include commentary that: may defame or discredit another person or business; may disclose private, personal, or confidential information; might be considered obscene, offensive, menacing, or abusive; might infringe the intellectual property rights of others; or may violate any law, regulation, standard, content requirements or code promulgated by any relevant authority or industry body.
4.29. NOT ACCEPT the Video including any contact details (e.g. phone, skype, email, social media or website address)
4.30. NOT ACCEPT the Video including any links to websites or other tools with additional functionality (e.g. contact a provider, enquiry or booking call-to-actions such as “book inspection” or “contact provider”). The above rules apply to all forms of moving images permitted by us for use on our Platform including images involving video, animated, virtual, rendered and scanned technologies.
4.31. NOT ACCEPT other inappropriate content: Using the Service for any unlawful, illegal, malicious or improper purpose or in a way that is inappropriate having regard to our need to maintain the quality of our Platform to ensure a positive experience for consumers. For example: it is not acceptable to, in your use of the Service, display material that: may defame or discredit another person or business; may disclose private, personal or confidential information; might be considered obscene, offensive, menacing, or abusive; might infringe the intellectual property rights of others; may violate any law, regulation, standard, content requirements or code promulgated by any relevant authority or industry body.
4.32. NOT ACCEPT listings that fail to verify the authenticity: Allowing listings to be uploaded to our Platform, or for a person or entity using the listing, for an improper purpose. An improper purpose includes committing fraud against a consumer by impersonating a real property management or property owner who is authorised to advertise the property in order to obtain funds by deception. Where this occurs, you must satisfy us that you have adequate procedures to verify the authenticity of listings in place and ensure that they are uploaded for a proper purpose, which may include an agency authority with the owner of the property.
4.33. NOT ACCEPT misusing a product or feature: Deliberately misusing a product or feature to gain an unfair advantage or to disadvantage another party.
5. BREACHING THIS POLICY
5.1. If you use the Service in a way that breaches this Acceptable Use Policy – Accommodation Provider, you are in breach of your agreement with housingnet.com.au for your use of the Service.
5.2. Breaching this Acceptable Use Policy – Accommodation Provider may result in us taking action to remedy the breach. This might include terminating or suspending your subscription; deleting a specific listing, deleting an Accommodation Provider profile, not permitting a listing to be uploaded to the site in the first place or any other action that we are permitted to take under our agreement with you and according to law.
5.3. For the avoidance of doubt, if we give you notice of a breach or breaches of this Acceptable Use Policy – Accommodation Provider, we may require you to remedy those breaches AND otherwise become wholly compliant with this Acceptable Use Policy – Accommodation Provider within the period specified in the notice. We will ensure that any notice period is reasonable having regard to the nature of the breach, the impact on consumers, the need to maintain the integrity of our Platform and the anticipated time required to remedy the breach.
5.4. We reserve our rights to take suspension or termination action where: you are in material breach of any requirement of this Acceptable Use Policy – Accommodation Provider; or you are in breach of any requirement of this Acceptable Use Policy – Accommodation Provider and fail to remedy that breach within the period specified in such a notice.
5.5. Where we suspend or delete listings or listings are prevented from being uploaded due to a breach or attempted breach by you of this Acceptable Use Policy – Accommodation Provider, you will remain liable for your contractual obligations until the date of termination or expiration of your agreement with us
